Terms and Conditions
This document contains the terms and conditions applying to DealGuild.com members. Please read it carefully. It outlines your obligations to DealGuild.com ("DealGuild") as well as DealGuild's obligations to you. It is your responsibility to read and understand all terms and conditions binding members of DealGuild. By becoming a member of DealGuild you agree to the following terms and conditions.
1. Account Eligibility
1.1 Members must be a resident of Canada, 18 or older.
1.2 All members must be an individual. No automated scripts, bots or machine run services may be used to earn any financial benefit through DealGuild. Any account run by other than an individual person, being run directly by that person is subject to termination, with all earnings contained within in that account being forfeited to DealGuild.
1.3 DealGuild allows only one account per person and that account may only be used by that person. If an account is determined to be in use by multiple individuals, or that an individual is operating multiple accounts, all accounts involved will be terminated, at our discretion with the forfeiture of any accrued earnings.
1.4 The DealGuild cash back program is only available through the DealGuild website ("the site") (http://www.dealguild.com). DealGuild is not responsible for any inability to access the website for any length of time. Including but not limited to, your ability to connect to the internet, your ability to reach the DealGuild.com website or your ability to log in to your account with DealGuild. As well, DealGuild is not responsible nor liable in the event that DealGuild is not available for use for a period of time.
1.5 DealGuild is against all forms of spam. Any account found to be posting links with DealGuild account information imbedded in it outside of the DealGuild website will be terminated with the forfeiture of any accrued earnings.
2. Cash Back
2.1 When members of DealGuild complete a transaction through links provided on the site they are eligible to earn the cash back amount specified on the site for qualified purchases. DealGuild will, in good faith, attempt to post the correct cash back amounts and rates, but it is not possible to guarantee rates will be available at the posted rate at the time of your purchase.
2.2 All transactions are with the individual merchants and are not with DealGuild. We will do our best to ensure we are never associated with fraudulent or misleading merchants however we can not guarantee performance by the merchants featured on the site.
2.3 All purchases and cash back amounts are traced through a third party network and reported to DealGuild by the network and the merchant. DealGuild will make all efforts to ensure that purchases by members are reported accurately, however DealGuild can not guarantee the effectiveness of these third parties. DealGuild will not be held responsible for failed tracking or any errors in tracking purchases. If there is an error in tracking your transaction DealGuild will attempt to intercede on your behalf with the relevant third party, however the third party's decision is final.
2.4 Cash back payouts are subject to adjustment for reversals and adjustments to the transactions they are calculated from. Reversals and adjustments may arise from any of the following, but is not limited in definition to: merchandise returns, sales adjustments, credit memos or ineligibility to participate in certain programs.
2.5 Cash back will only be calculated on the net amount of the purchase as defined by the merchant.
2.6 In order for a purchase to qualify for cash back the member must be logged in to their account and have cookies enabled on their web browser. This includes enabling both first and third party cookies. All qualifying purchases must begin by clicking through the affiliated merchant's link as appearing on the DealGuild site and must be completed within that session. Any purchases made outside of that session may not be tracked. Use of coupon codes or any other links from any source other than DealGuild may invalidate your eligibility for cash back for that purchase.
2.7 The determination of whether or not a purchase made through a DealGuild Affiliated Merchant is a "Qualified Purchase" is at the sole discretion of DealGuild and/or the merchant.
2.8 DealGuild makes no guarantees to payment until payment has been received from the merchant or network.
2.9 DealGuild reserves the right to terminate any membership, with the forfeiture of any accrued earnings in the event that it is not possible to contact a member at the email address provided to DealGuild.
3. Payment
3.1 Accrued cash back amounts will be paid out monthly, with no minimum. Payment will only be made once DealGuild has received payment from the merchant or network handling your purchases, for your specific purchase.
3.2 It is up to you to ensure that your account information is current and accurate in order to facilitate payment of your Cash Back amounts. DealGuild is not responsible for any misdirected payments due to members' information not being correct at the time of payment.
4. Forums and Member Postings
4.1 All postings to the forums, deals posted by users, or any other comment posted by any user of DealGuild.com is the property of that user, and expresses their views, not those of DealGuild.com, or Frigid Moose Media Ltd.. Although DealGuild will attempt to ensure that objectionable content is not included in users' postings, it is not possible for us to review the content of every message.
4.2 By joining DealGuild you are warranting that you will not post messages that are considered obscene, vulgar, sexually oriented, hateful, threatening, or are otherwise in violation of any laws. You also are warranting that you will abide by the forum rules as found HERE
4.3 Although all postings are the property of the member who posted them, DealGuild reserves the right to remove, edit or move these postings from the DealGuild website, at our discretion.
5. Legal
This Agreement (Terms and Conditions) will be governed by the laws of the province of Manitoba, without reference to rules governing choice of laws.
Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
